Agreement to Terms

By creating an account or using the Nexsyna mobile application or website ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Nexsyna ("we," "our," or "us").

Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's permission. We may terminate accounts that do not meet this requirement.

Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@nexsyna.com if you suspect unauthorized use. You may not create multiple accounts, transfer your account, or impersonate another person. We reserve the right to suspend or terminate accounts that violate these Terms.

Acceptable Use

You agree not to use the Service to:

• Post false, misleading, or fraudulent information.
• Harass, abuse, threaten, or harm other users.
• Impersonate any person or entity.
• Distribute spam, malware, or unsolicited commercial messages.
• Post content that is illegal, defamatory, obscene, or infringes any third-party intellectual property rights.
• Scrape, crawl, or automate access to the Service.
• Attempt to reverse-engineer, decompile, or tamper with the Service.
• Use the Service for any purpose other than legitimate professional networking.

User-Generated Content

You retain ownership of content you post (profile text, photos, messages). By posting content on Nexsyna you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute that content solely to provide the Service.

You represent that your content does not violate any law or third-party right. We have a zero-tolerance policy for objectionable content, including content that is hateful, sexually explicit, violent, or depicts illegal activity. We may remove such content and terminate the responsible account without notice.

Content Moderation and Reporting

If you encounter content that violates these Terms, use the in-app Report function. We review reports and take action - typically within 24 hours for urgent safety issues. Users who are found to have submitted objectionable content or engaged in abusive behavior may be suspended or permanently banned. You may also block any user from within the app.

Premium Subscriptions

Nexsyna offers premium features through an auto-renewing subscription available via Apple In-App Purchase:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel subscriptions in your Apple ID account settings.
• No refunds are provided for partial subscription periods, except as required by applicable law.
• Free trial periods, if offered, will convert to paid subscriptions unless cancelled before the trial ends.

Intellectual Property

The Nexsyna name, logo, and all content we create (design, code, text, graphics) are owned by Nexsyna and protected by intellectual property law. You may not use our branding without written permission. Nothing in these Terms grants you a license to our intellectual property beyond what is necessary to use the Service.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. Nexsyna does not endorse any user, profile, or opportunity listed on the platform and is not responsible for interactions between users that occur outside of the Service.

Limitation of Liability

To the fullest extent permitted by law, Nexsyna shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Account Deletion

You may delete your account at any time using the "Delete Account" option in the app's Settings. This permanently and irreversibly removes your profile, messages, matches, and associated data. See our Privacy Policy for details on data retention.

Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for any other reason at our sole discretion. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

Apple End User License Agreement

If you downloaded the Nexsyna app from the Apple App Store, your use is also subject to Apple's standard Licensed Application End User License Agreement (EULA). Apple is not a party to these Terms and bears no responsibility for the Service.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in the courts of Texas.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use of the Service after changes take effect constitutes acceptance. If you do not agree to the revised Terms, you must stop using the Service.
